Police roadblock on Sheridan yields 2 DUI charges

University Police and the Evanston Police Department joined together to set up a roadblock on Sheridan Road for most of Friday night in an attempt to catch people driving under the influence of alcohol, police said.

UP arrested two men, Steven Neczek, 25, of Chicago and Joseph Yolles, 35, of Winnetka. Both were charged with DUI.

Sgt. Tim Reusse of EPD said his department also arrested other drivers.

The roadblock, known as a roadside safety check, was set up on the 2100 block of Sheridan, Reusse said. Police stopped every car and asked drivers to pull into the Garrett-Evangelical Theological Seminary parking lot. Police checked the cars for broken headlights or anything else unusual.

Often during a safety check, police will smell alcohol on a driver’s breath, Reusse said.

The police then will ask the driver to perform a field sobriety test, Reusse said. Although results from the test cannot be used in court, they are necessary to show probable cause of filing charges.

With probable cause, police can bring suspects back to the station and give them a breathalyzer test – the results of which are allowed in court, said Sgt. David Perkins of EPD.

EPD and UP team up a few times a year to perform the “spur of the moment” safety checks, Reusse said. The next roadblock has not been scheduled.

Two other men were charged with driving under the influence Thursday in Evanston, Perkins said.

Michael Kelly, 20, of Chicago was arrested at about 1:45 a.m. on the 1400 block of Sherman Avenue. He also was charged with possession of drug equipment after police found a water bong in his car, Perkins said.

Kelly refused to take a breathalyzer test, police said. Because of the refusal, he will suffer a greater penalty if he is found guilty, Perkins said.

Lucas Mason, 25, of Evanston was arrested on the 600 block of Noyes Street at about 2:10 a.m. Mas also refused a breathalyzer test.

All four suspects are scheduled to appear Dec. 13 in Circuit Court in Skokie.
