State appellate court sides with Evanston resident who sued city after injury

A state appellate court sided last month with an Evanston resident who sued the City of Evanston in 2004 after falling and injuring her elbow, according to court documents.

The plaintiff, Evanston resident Elizabeth Gutstein, said she fell in July 2004 due to negligent maintenance by the city, the court opinion said. Gutstein said she tripped on a “softball-sized” depression in an alley near her house and injured her elbow.

In 2004, the Cook County Circuit Court decided the city was liable for Gutstein’s injuries, with a verdict of more than $100,000 in Gutstein’s favor, the court opinion said. The city appealed that decision, which the state appellate court upheld March 12.
